Signal Kit, L.L.C. (“Signal Kit,” “we,” “us,” “our”) provides a technology solution designed to eliminate fragmented communication in the primary and secondary education communities. The solution provides a secure, simple, and manageable place to connect school administrators, teachers, parents, and students and is comprised of this website, a user portal accessible through http://app.signalkit.com, and services accessible through the user portal (collectively, “Signal Kit”).

You signify your assent to this Privacy Notice by using Signal Kit. You must have a parent or legal guardian review this Privacy Notice with you and agree to it on your behalf if you are not of legal age to form a binding contract with us (age 18 in most states). Please do not use or continue to access Signal Kit if you do not agree to this Privacy Notice.

What This Privacy Notice Covers

This Privacy Notice governs the manner in which we collect, use, disclose, and protect your personal information. This Privacy Notice does not apply to websites of companies that we do not own or control or to individuals that we do not employ or manage.

Children’s Privacy

We do not knowingly collect information from children under the age of 18 (“Child” or “Children”), nor do we solicit personal information from Children. If you are a Child, please do not send any personal information about yourself to us. If you are the parent or legal guardian of a Child, we urge you to instruct your Child to never give out their real names, address, phone numbers, or any other personal information on the Internet without your permission.

If we learn that we have collected personal information from a Child, we will delete that information as soon as possible. Please email us at privacy@signalkit.com if you believe we have collected personal information from a Child.

Personal Information Signal Kit Collects

Information Provided by an Institution:. Each participating school district or school (collectively, “Institution”) will provide us certain personal information about you in order for you to access and use Signal Kit. That information may include: your first and last name, mailing address, email address, telephone number, and relationship to the student if you are a student’s parent or legal guardian.

Admin Role: We use StaffID, phone number, email address, group memberships, school memberships and district memberships from district-provided data.

Staff Role: We use StaffID, phone number, email address, group memberships, school memberships and district memberships from district-provided data.

Teacher Role: We use TeacherID StaffID, phone number, email address, class rostering, group memberships, school memberships and district memberships from district-provided data. 

Student Role: We use StudentID, phone number, district email address, class rostering, group memberships, school memberships, district memberships and family relationships from district-provided data.

Parent/Guardian/Contact Role: We use phone number, email address, group memberships, school memberships, district memberships and family relationships from district-provided data.

Emergency-Only Contact Role(if applicable): We use phone number, email address and any emergency contact information from district-provided data. 

Community Member Role: We use email addresses provided by the community member via a district or school sign up form into which they have entered the information manually.

Information You Give to Us: You may voluntarily give us certain personal information when you claim your Signal Kit account and use Signal Kit. This information may include the above information and any other information you provide to us.

Sharing of information: We will only share information with Educational Researchers or with Educational Agencies performing a function for the school.

Student Data: As between Signal Kit and you, any data that we collect from you that includes any information that is directly related to a student that is maintained by a school district, school, or by us, as part of the provision of Signal Kit (“Student Data”), belongs to you and we claim no right, title, or interest in any Student Data that is made available to us. Student Data may include “educational records” as defined by the Family Educational Rights and Privacy Act.

Information We Collect Automatically: Whenever you access or use Signal Kit, we automatically receive and record information from your browser, which may include: the device you use to access or use Signal Kit, your IP address, the type of browser or application you are using to access our products and services, the identity of the page or feature you are requesting, referring and exit pages and URLs, platform types, preferences you submit and preferences that are generated based on the data you submit, and number of clicks (collectively, “Non-Identifiable Data”). We also collect information through the use of cookies, web beacons, and other technology. See the section labeled “Tracking Technologies and Do Not Track Signals” below for more details.

Review of Personally Identifiable Information: A parent, legal guardian, or eligible pupil may review personally identifiable information within in a pupils records in multiple ways: 1) If the Signal Kit implemenation is within an SIS-partner application, the individual can access the respective SIS vendor user portal and correct erroneous information. Any updated pupil information data will sync with Signal Kit within 24 hours. The parent, legal guardian, or eligible pupil may also contact their Signal Kit School Admin for this information. 2) If the Signal Kit implemenation is NOT within an SIS-partner application, the parent or legal guardian must contact their Signal Kit School Admin for this information. Eligible pupil’s may view and correct personally identifiable information in the Signal Kit Personal Settings page. Those changes will take effect immediatly within Signal Kit.

How Your Information Is Used

Personal Information: We may use your personal information:

  • to provide our products and services;

  • for the specific purpose for which that information was collected;

  • to address your customer service or technical support questions;

  • to alert you of new products or services, features, or enhancements;

  • to improve our products and services;

  • as otherwise permitted by law; and

  • for any other purpose with your consent.

  • Non-de-identified student data is used strictly for communication purposes by customers, customer support and district implementations. This data is accessible only by specific Signal Kit personnel with current background checks.  

  • Non-Identifiable Data: We may use and share Non-Identifiable Data (e.g. non-personal, de-identified information that can’t be used to identify you) for any lawful business purpose without any obligation or accounting to you. When we do so, we will take reasonable measures to ensure that the Non-Identifiable Data is not personally identifiable and cannot later be used to identify you. De-identified student information is used for product improvement and customer support by specific Signal Kit personnel with current background checks. Product development and testing processes use dummy data representing students and created solely for this purpose and no district data is used for these purposes. 



How Your Information Will Not Be Used

When We May Disclose Your Personal Information

We will only disclose your personal information for the purposes described below:

With Your Consent: We may share your personal information when we have your consent. You can revoke your consent at any time by providing notice to us at privacy@signalkit.com.

Service Providers
We may employ other companies and people to perform tasks on our behalf and we may need to share your personal information with them to provide services to you. Unless we tell you differently, they do not have any right to use your personal information beyond what is necessary to assist.  These providers have limited access to your personal information to perform these tasks on our behalf, and are contractually bound to protect and use it only for the purpose for which it was disclosed and consistent with this Privacy Policy. Please see here for a list of the third-parties we work with to provide the Service.

Signal Kit works with vendors, service providers, and other partners to help us provide the Service by performing tasks on our behalf.  We may need to share or provide information (including personal information) to them to help them perform these business functions, for example sending emails on our behalf, database management services, database hosting, providing customer support software, and security. 

Please see  this list of the third-parties we work with to provide the Service. Generally, these service providers do not have the right to use your personal information we share with them beyond what is necessary to assist us. Additionally, these service providers must adhere to confidentiality and security obligations in a way that is consistent with this Privacy Policy.

Data Breach Policy
If we learn of a security breach, we will attempt to notify you electronically (subject to any applicable laws) so that you can take appropriate protective steps; for example, we may post a notice on the Signal Kit Website or elsewhere on the Service, and may send email to you at the email address you have provided to us. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

Definition 

A breach is any unauthorized acquisition of computerized data that compromises the security, confidentiality, or integrity of personal information that we maintain. 

Personal information 

Unencrypted information containing: individuals’ names or initials, contact information such as email address or phone number, state or district identification numbers and other personal identifiers.

Timeframe 

In the event of a data breach, the goal is to provide notice to affected parties as soon as reasonably possible. 

Recipients of the Notice 

We will notify both the impacted users and any known schools to which those users belong via contact information on record. 

Information in the Notice 

• Company contact information. 

• A general description of the breach incident
• An explanation, to the best of our knowledge, of what happened. 
• A listing of the types of personal information that is believed to be compromised. 
• If known, the date and time of the breach, or a best estimate. 
• Whether the notification was delayed as a result of law enforcement. 
• What steps the Company has taken to mitigate the situation, prevent it from happening again, and advice to the impacted individuals on how they can best protect themselves. 


Method of notification 

Notifications should be sent via email to all impacted users. Written notice may be sent to the impacted schools in addition to email. 

 

Protection of Signal Kit: We may disclose your personal information at the request of law enforcement or government agencies or in response to subpoenas, court orders, or other legal process to establish, protect, or exercise our legal or other rights or to defend against a legal claim or as otherwise required or allowed by law. We may disclose your personal information in order to protect the rights, property, or safety of a user or any other person. We may disclose your personal information to investigate or prevent a violation by you of any contractual or other relationship with us or your illegal or harmful activity.

Business Transfers: In the event that all or a portion of Signal Kit or its assets are acquired by or merged with a third-party, personal information that we have collected from users would be one of the assets transferred to or acquired by that third-party. This Privacy Policy will continue to apply to your information, and any acquirer would only be able to handle your personal information as per this policy (unless you give consent to a new policy). We will provide you with notice of an acquisition within thirty (30) days following the completion of such a transaction, by posting on our homepage and by email to your email address that you provided to us. If you do not consent to the use of your personal information by such a successor company, you may request its deletion from the company. In the unlikely event that of Signal Kit goes out of business, or files for bankruptcy, we will protect your personal information, and will not sell it to any third-party. 

 

Marketing Communications

You have the right at any time to prevent us from contacting you for marketing purposes. You can opt-out of promotional communications by following the unsubscribe instructions provided in each promotional email that we send to you. We may continue to send you administrative emails; for example, periodic updates to our Privacy Notice, even if you indicate that you no longer wish to receive promotional email from us.

Retention And Modification Of Your Personal Information

Correcting, Updating, Accessing, or Removing Personal Information: You can correct, update, or remove your personal information if it changes or if you no longer want to receive information from us beyond information related to our services. This can be done within your SIS portal or the Signal Kit app.

You may also request access to your personal information that we collect by sending a request to privacy@signalkit.com. We may not be able to completely remove your personal information from our systems in certain circumstances. For example, we may retain your personal information for legitimate business purposes, if it may be necessary to prevent fraud or future abuse, if required by law, or as retained in our data backup systems or cached or archived pages. All of your personal information that we keep will continue to be subject to the terms of this Privacy Notice to which you have previously agreed.

Your California Privacy Rights: California Civil Code Section 1798.83 permits users that are California residents to request certain information regarding our disclosure of personal information to third parties for such third parties’ direct marketing purposes. If you are a California resident and would like to make such a request, please contact us at CA-privacy@signalkit.com.

Deletion: We will delete any or all data that we have collected from Students per the request of the School or District, at any time.

Tracking Technologies And Do Not Track Signals

Tracking Technologies: We may use cookies, beacons, tags, scripts, and other tracking technologies to track how you use our websites. We may also use JavaScript or other computer languages to gather the sorts of information described above and other details about your interactions with our websites.

We use cookies for a variety of reasons, including to save your account settings and for authentication. You may adjust your web browser settings if you do not wish to receive cookies from us but this may prevent you from taking advantage of some of the functions and features available on our websites.

Do Not Track Signals: Our websites do not currently recognize or respond to “do not track” signals.

Content That You Provide

This Privacy Notice applies to how we collect and use your personal information. Please refer to our Terms of Service Agreement (viewable at signalkit.com/terms) for information about our policies and your rights of ownership relating to information, photos, videos, text, graphics, music, sounds, and other material or information provided by you, other Signal Kit users, Signal Kit, or third parties (collectively, the “Content”). You understand and acknowledge that the Content you provide when you use Signal Kit may allow a third party to personally identify or locate you.

Links To Other Websites

We do not post links to third party websites in Signal Kit. If a Signal Kit user posts a link in Signal Kit, please be aware that we are not responsible or liable for any content, advertising, products, or other materials on or available from third party websites or for any privacy or other practices of the third parties operating those websites.

Users Outside Of The United States

Signal Kit is hosted in the United States and is governed by United States law. If you are using Signal Kit from outside the United States, please be aware that your personal information may be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. By using Signal Kit, you consent to your personal information being transferred to our facilities and to the facilities of those third parties with whom we share it as described in this Privacy Notice.

How We Protect Your Personal Information

We take reasonable steps to maintain the security of your personal information; however, no data transmission over the Internet can be guaranteed to be completely secure. Accordingly, we cannot ensure or warrant the security of any information that you transmit or provide to us, so you do so at your own risk.

Changes To This Privacy Notice

We reserve the right to change, modify, add, or remove portions of this Privacy Notice. Signal Kit will notify current customers 30 days in advance of material changes to privacy policies, including practices around new or additional data collection, or practices that may lessen the previously noted protections around student data privacy
